The EU & IMEA Marketing Compliance Manager is responsible for managing marketing compliance and data privacy for Brown-Forman’s European and IMEA business. This role is client-facing, giving compliance advice directly to both internal and external stakeholders. Marketing compliance involves promoting and ensuring compliance with all applicable (in particular, EU and local European and IMEA markets) laws, regulations and industry codes, as well as with Brown-Forman’s corporate social responsibility commitments.
Advise regional and global marketing teams, senior management and other departments on marketing compliance and social responsibility issues on the marketing of alcohol.
Review and evaluate marketing and promotional activity across all media channels. Interpret legislation and regulatory guidelines as well as competitor practices to provide commercially focused, pragmatic advice, manage risk and offer innovative solutions to compliance challenges.
Act as subject matter expert on marketing compliance across all media channels in restricted markets (where marketing of beverage alcohol products is subject to increased restrictions, including prohibition), providing proactive advice to global and regional brand teams.
Promote marketing compliance by creating and delivering market and subject specific training to marketers, agencies and distributors.
Monitoring and reporting on developments in applicable EU and local market laws and regulations, as well as decisions made by regulatory bodies. Ensure that marketing policies, procedures and processes are updated appropriately.
Participate in the creation of marketing policies to ensure that new marketing practices and channels are used in compliance with BF’s legal, regulatory and CSR commitments.
Engage with external stakeholders, including regulatory bodies and other authorities, and investigate and respond to complaints and investigations to achieve appropriate resolutions.
Manage all marketing and advertising contracts including agency, NDA, sponsorship and promotional activities. Draft and negotiate contracts, provide advice to internal clients, and advise on contractual issues.
Provide quarterly reports on Europe and IMEA marketing compliance matters to the Chief Ethics & Compliance Officer and provide input into the compliance database
In addition this position will provide support with data privacy in the region
2-4 years Post-Qualified Experience
Honours degree in law and legal practice course required.
At least 5 years’ experience in advertising and marketing compliance, from heavily restricted industry background in a European role. In addition, experience in prize promotion law, consumer law and intellectual property law is required.
Demonstrated capability to undertake substantive legal or quasi-legal tasks requiring the exercise of judgement, evaluation, analysis and risk assessment.
Demonstrated experience in a ‘client-facing’ role, with appropriate communication skills - ability to clearly relay sensitive information and give direction and guidance to all levels of the organisation.
Ability to work independently, without supervision and to make decisions, escalating where appropriate.
Excellent written analysis skills (will be subject of test during hiring process).
Demonstrated ability to execute responsibilities with planning and organization in a high volume, deadline oriented environment; ability to perform work with accuracy and attention to detail amidst frequent interruptions.
Demonstrated self-starter with a high level of initiative to make independent judgments.
Written and spoken English language fluency. Native English speaker; additional languages preferred.
